Background
Sarah joined Chambers in 2008 following successful completion of pupillage. She has a general chancery and commercial practice, and has a particular interest in trusts, probate and inheritance act matters and property disputes.
Areas of Practice
Trusts, Probate and Inheritance
Sarah advises in cases involving:
- Claims under the Inheritance (Provision for Family and Dependants) Act 1975
- Claims under Trusts of Land & Appointment of Trustees Act 1996
- Contentious probate
- Construction of wills
- Court of Protection
She has given a seminar on the recent case of Baynes v Hedger [2009] EWCA Civ 374.
Recent cases include a contested deputyship application in the Court of Protection.
Property
Sarah has acted in disputes involving:
- Easements and covenants;
- Boundary disputes;
- Co-ownership;
- Town and village greens;
- Law of commons;
- Mobile homes;
- Landlord and tenant, including possession, disrepair and claims under s.214 of the Housing Act 214;
- Mortgage, including possession claims;
- Professional negligence.
Recent cases include acting, on behalf of both landlords and tenants, in gateway (b) defended possession proceedings.
She recently presented a seminar on procedure in town and village green applications, and will be presenting a seminar on easements in March 2011.
Commercial and Insolvency
Sarah is regularly instructed in matters involving:
- Commercial contracts, breach of contract, agency and guarantees
- Sale and supply of goods and services
- Partnership disputes
- Claims against banks
- Credit, including consumer credit and hire purchase
- Company and personal insolvency, including winding-up petitions and other Insolvency Act applications
