Areas of Practice

Before joining St John’s in 2005 Julian was a tenant for seven years at a leading London construction law set, where he regularly undertook both advocacy and advisory work in a variety of construction and commercial disputes. Since his move to the West Country he has continued with this line of work and is involved in all areas of construction and commercial litigation including building disputes for both contractors and employers, as well as associated professional negligence, product liability and insurance work. He has appeared at all levels from the county court to the Court of Appeal and also has experience of alternative dispute resolution including mediation and adjudication.

Construction & Engineering

In construction disputes Julian has particular experience of dealing with complex and technical expert evidence and places particular emphasis on sensible commercial advice in the wider context of any dispute. He has assisted both contractors and employers to resolve disputes at an early stage where appropriate and represented the contractor (successful at every level) in a claim for payment on an interim certificate which ultimately reached the Court of Appeal, in RMS V Jervis [2004] 1WLR 1867.

In the course of his insurance practice he has advised both policyholders and insurers on all aspects of insurance policy cover, including liability for fire damage and accidental death, the effects of joint insurance particularly in a construction context, exclusion clauses, non-disclosure and misrepresentation.

He also has much experience of dealing with claims, often on behalf of local authorities, in relation to tree root and other environmental damage (ranging for example from chemical leaks to damage caused by landslip), including disputes over the extent of remedial work required and claims for consequential loss. He has very wide experience of dealing with claims in relation to injuries, including fatalities, on building sites.
