Areas of Practice
Philip’s practice embraces the full range of chancery and related commercial fields and his time is divided between advising, drafting (contentious and non-contentious) and litigating. The areas of specialism in which he regularly receives instructions are:
Wills, estates, Inheritance Act claims, trusts
- Drafting and interpretation of wills, deeds of variation and related IHT/CGT taxation advice, rectification claims and contentious probate
- The administration of estates generally, passing over, removal of PRs, administration actions and accounts (including of attorneys)
- Inheritance Act claims for all classes of applicants, frequently in tandem with trust claims, including advice to court on behalf of minors and patients and related IHT/CGT taxation advice
- Drafting trusts and related deeds, IHT/CGT and trusts, claims for breach of trust, dishonest assistance, knowing receipt and related proprietary remedies
Property
- All aspects of real property including conveyancing and registration, restrictive covenants, easements, customary rights, adverse possession, boundary disputes, co-ownership, estoppel, mortgages and charges
- Commercial landlord and tenant matters including renewals, rent reviews, surrender, forfeiture and dilapidations
- Residential landlord and tenant matters
Commercial and insolvency
- Professional negligence of solicitors, particularly involving property, trust and estate matters
- Commercial contracts and breach of contract including sale of goods and consumer credit matters
- Shareholder disputes
- Partnership disputes
- Personal insolvency including statutory demand disputes, annulment applications, orders for sale, trustee costs, bankruptcy and divorce
