Judgment given in the Supreme Court

The Supreme Court has now given judgment in Roberts v.Gill & Co in which Leslie Blohm QC and Guy Adams appeared.

The case deals with a number of interesting issues including the circumstances in which a derivative claim can be made, the meaning and effect of section 35 Limitation Act 1980 and when the legal owner of a right of action must be joined in proceedings. The only unanimous finding was that on the facts of the case it would be wrong for an appeal court to interfere with the first instance judge’s conclusions on whether there were special circumstances in this case which would justify the bringing of a derivative action.
