Charles is instructed on all aspects of property law litigation and takes a particular interest in real property matters, including those concerning boundaries, easements, trusts of land, proprietary estoppel, restrictive covenants and ToLATA. He is ranked as a ‘Leading Junior’ in The Legal 500 2026 guide for property and construction.
Charles is experienced in leasehold-specific disputes such as those relating to service charges, leasehold covenants, forfeiture, and leasehold enfranchisement. He also frequently deals with property matters involving tortious elements such as trespass and nuisance.
In addition to individuals, Charles’ clients include local authorities, insurers, statutory utility undertakers, and commercial developers. He also has experience in discrete areas such as: neighbour disputes under the Party Wall etc. Act 1996, the rights of mobile home and site owners under the Mobile Homes Act 1983, the liability of national utility enterprises under the New Roads and Street Works Act 1991, and disputes concerning liability for national non-domestic rates.
Charles acts for landlords and tenants in disputes arising from both residential and commercial leases. He is instructed across a full range of such disputes, including possession proceedings, contested commercial lease renewals, claims for disrepair, and applications for housing-related injunctions and committals.
Recent cases include:
- Contested residential boundary dispute concerning informal boundary agreements.
- Defended applications to be registered as proprietor of land on the basis of adverse possession under the Land Registration Act 2002.
- A long-running neighbour dispute with inter-related tortious, boundary and right of way issues.
- Contested liability orders in respect of national non-domestic rates.
- No-fault possession proceedings defended on the basis of proprietary estoppel and a constructive trust analysis.
- Claim concerning alleged mistake in the context of registered conveyancing.
- Application to determine the reasonableness of service charges levied under the terms of a residential long lease.
- Advising on the presence of various implied easements in an agricultural-residential setting.
- Contested application before the First-tier Tribunal (Property Chamber) for the determination of exact boundaries under r. 118 of the Land Registration Rules 2003.
- Advising on enforceability of various freehold covenants in respect of high-value commercial land.
