Robert Mills has achieved settlement for a Claimant in a clinical negligence case concerning a negligent failure to diagnose a scaphoid fracture.

The delay in treatment resulted in significantly reduced movement and strength in the Claimant’s wrist. As a result the Claimant argued that she would no longer be able to pursue her career as a nurse and loss of earnings and pension claims were advanced. The Claimant further claimed that she had suffered a loss of congenial employment. The loss of earnings claims were contested by the Defendant who argued that the index injuries had not caused her to give up her nursing degree. A provisional damages claim was made for the risk of future surgeries and their complications. The case was pleaded at over £1 million and settled at mediation.
