Guy appeared for the claimants on the appeal and cross-appeal in this case, which was heard over 2 days with judgment reserved. The case raised a number of issues which are of current legal interest concerning the relationship between the court’s substantive jurisdiction and procedural powers and between public and private rights.
A number of the issues bore similarities to issues which were also raised, but not ultimately decided, in the Supreme Court case, decided on the second day of the hearing in Price v Nunn: Virgin Atlantic Airways Ltd v Zodiac Seats UK Ltd [2013] 3 WLR 299.
