The principle of material contribution is one which causes confusion both to medical experts and to practitioners.  Terminology is not used consistently and the sands seem constantly to be shifting. In this presentation, Justin Valentine, Deputy Head of our Clinical Negligence team examines recent case law and clarifies the key concepts. Practitioners can and should be confident in making assertions of material contribution in clinical negligence cases.

Allegations of failing properly to consent are often made but what do they add?  There is a danger of failure to consent allegations being used as a fall back position which risks weakening rather than strengthening the case. Justin reviews recent case law and with reference to his own practice demonstrates when and how consent can best be raised.
