John Sharples discusses how restrictive and positive covenants can affect the development of land, when they bind and what the owner/developer can do to mitigate that risk at the Property Litigation Update. He will also look at the sort of covenants typically encountered (restricting use or prohibiting certain uses, preventing nuisance/annoyance or requiring consent) and clauses permitting development. The talk will provide practical guidance for land owners, developers, prospective purchasers and those affected by the development.
