Instructed by Kerry Dutton and Kelly Tarmas of Lyons Davidson Solicitors, Ben Handy and Sophie Howard acted for a claimant who sustained life changing injuries in a motorcycle accident. Primary liability was admitted but contributory negligence, causation and quantum remained in dispute, and an 8-day trial was fixed for the middle of 2027.

The accident had caused devastating bilateral leg injuries. Despite nine operations and a lot of hard work on rehabilitation, permanent and increasing mobility problems were inevitable. Issues included lifelong loss of earnings, care, the need for specialist accommodation, mobility aids and equipment.

With careful marshalling of the lay and expert evidence from eight different specialisms, the parties were able to agree a final settlement of over £2 million at a Joint Settlement Meeting, giving the claimant security for the future and enabling him to put litigation behind him without the need for a trial.
