Chambers UK 2024, Real Estate Litigation

Adam is a member of the Agricultural Law Association and is a well-respected barrister with significant experience of farming and agricultural matters.

He is one of the leading Property Law practitioners in the South West and Wales, so his agricultural work often has a property flavour (including trespass & boundary issues; estoppel claims; land purchase issues, landlord & tenant disputes and rights of way).

However, Adam also has substantial experience of farm partnership cases and related commercial issues, and notable experience of wills, trusts and probate matters, such that he is able to advise and assist in a very wide range of agricultural cases. Of late, he has been instructed in a number of complex hybrid cases, which raise issues involving various different areas of law.

His most notable agricultural case to date was a week-long trial before HHJ Mitchell. The case concerned a hotly contested Farm Business Tenancy (under the Agricultural Tenancies Act 1995), involved other complicated matters such as lease/licence distinction arguments, issues relating to the nature of a “grass keep” agreement and what constitutes implied surrender of a lease (in an agricultural context).

You can read more about that case here.

More recently he has:

  • Obtained an urgent interim injunction before HHJ Carr (in respect of right of way dispute) which was imperative for the continued smooth operation of his client’s farm.
  • Won a three-day trial in dramatic fashion – preventing unlawful access over his lay client’s agricultural land (a summary of this case is available here), and
  • Acted in various complex and very high value farming / equine partnership and proprietary estoppel cases.
