  • Probate claims concerning the formal validity of wills, testamentary capacity, knowledge and approval, undue influence and fraudulent calumny.
  • Claims under the Inheritance (Provision for Family and Dependants) Act 1975.
  • Claims for an account.
  • Applications for the removal of personal representatives and / or trustees.
  • CPR 64 applications.

Advising on:

  • Conflict of laws issues to include jurisdiction, domicile and governing law.
  • Questions of construction in relation to wills and trusts
  • Obtaining an interim grant of representation.
  • The costs consequences of trust and estate litigation, to include the personal representatives’ costs protection.

Recent cases include:

  • Currently instructed as sole counsel on a probate claim concerning an English estate worth circa. £3.2 million, in which conflict of laws issues arise. Kayleigh has advised, settled the pleadings and recently obtained an order for service out of the jurisdiction by an alternative method following the defendant’s attempts to evade service of the claim.
  • Instructed as English Counsel alongside Alex Troup KC in respect of offshore contentious probate litigation.
  • Advising on the validity and construction of a loan offer in a home-made will.
  • Advising on the law applicable to a charitable gift in a home-made will.
  • Advising on the appropriate limited grant to be taken out where there were chain of representation issues and pending probate proceedings.

    Kayleigh is originally from South Wales. She enjoys anything historical but has special interests in military / naval history, maritime history generally and marine archaeology. Kayleigh is an advocate for social mobility, having come to the Bar from a non-traditional background herself. She is always keen to become involved in any activity, event or initiative designed to encourage those from non-traditional backgrounds to enter higher education and professions that have social barriers.
