Jack has experience of a wide range of wills and trusts work, including both contentious and non-contentious matters. Jack has experience of advising and/or providing representation in respect of the validity and construction of trusts; perpetuity periods; the purposes of an apparent charitable trust; the construction of wills and challenges to their validity; 1975 Act claims; applications for the removal of executors and trustees; TOLATA matters; various issues relating to alleged delay in the administration of trusts and estates; and costs, including personal representatives’ costs protection.

Jack also has an interest in domicile and conflict of laws as they relate to trusts and estates. He is due to give a talk an upcoming talk on this during the latter part of 2024.

Jack’s recent cases includes:

  • Advising a beneficiary on a construction dispute relating to a gift of a portion of unregistered land, which was known by various names.
  • The mediation of a 1975 Act claim by a cohabitant, where the beneficiaries sought to rely on covert surveillance of the client from private investigators.
  • Advising and drafting in a spousal 1975 Act claim.
  • Advising on the construction of conditions in a will and vesting.
  • Advising executor on CPR 64 directions in the context of a stalemate between beneficiaries as to the estate accounts.
  • Acting in a pre-action disclosure application for a will in the High Court.
  • Advising an executor on questions arising in the administration of estates, including the need for and suitability of possession proceedings.
